Sinsuat, tagged by Davao City Mayor Rodrigo as a big-time shabu (methamphetamine hydrochloride) dealer in Mindanao, was reportedly arrested on Nov. 30 in his safehouse in Kabacan town.
Dulay, however, said Sinsuat was arrested not for illegal drugs but for car theft, adding the suspect is now in Davao City where the case was filed.
The police official said that in March 2003, Sinsuat was also apprehended in Kabacan for violation of Section 5 of Republic Act 9165 or the Comprehensive Dangerous Drug Act.
Section 5 of RA 9165 deals with the selling and transporting of any illegal drug or substance. It is non-bailable and carries a penalty of life imprisonment.
But to Dulay's surprise Sinsuat was able to post bail.
In another development, Dulay relieved Senior Insp. Abelio Jungaya as chief of Kabacan police three days after Sinsuat's arrest.
The police director clarified it was Jungaya who requested to be transferred to the provincial office due to his health condition which may affect his performance as municipal police chief.
He also denied reports Jungaya was relieved for failing to curb criminality including the proliferation of illegal drugs in Kabacan, saying those were only rumors meant to destroy the credibility of the local police.
Meantime, Kabacan Mayor Luzviminda Tan is expected to submit this week five nominees for the position vacated by Jungaya.
